DESCRIPTION OF THE INITIATIVE AND CONSUMER INFORMATION

The initiative is an online sale dedicated to customers of the O.R.E. S.r.l. online shop. The offer and sale of products through the website www.oreutensili.com are governed by the following General Terms and Conditions of Sale. The General Terms and Conditions of Sale are formulated in compliance with the regulations on contracts concluded outside business premises, and in particular with the provisions of Legislative Decree no. 206 of 6 September 2005 (Consumer Code) and subsequent amendments.

Acceptance of the general terms and conditions of sale

By placing an order in the prescribed manner, the Customer declares to have read all the information provided during the purchase procedure and to fully accept the General Terms and Conditions of Sale. ORE S.r.l. reserves the right to change the General Terms and Conditions of Sale by notifying on this page of the website. The applicable General Terms and Conditions of Sale are those in force at the time the order is placed. Any changes will be effective after publication on the website.

Once the online purchase procedure has been completed, the Customer will print or save an electronic copy and in any case keep these general terms and conditions of sale, in compliance with the provisions of articles 49 et seq. of Legislative Decree no. 206/2005 on distance sales.

HOW TO PURCHASE

The Customer can only purchase products present in the O.R.E. S.r.l. electronic catalogue at the time the order is placed, viewable online at (URL) http://www.oreutensili.com, as described in their respective information sheets. It is understood that the image accompanying the product description sheet may not be perfectly representative of its characteristics but may differ in colour, size, and accessory products shown in the picture. All information supporting the purchase is to be understood as simple generic informational material, not referable to the actual characteristics of a single product.

Products are offered at the price indicated on the website on the date the order is placed. Prices are understood to include VAT, which will be detailed in the invoice issued for the purchase of the product. Prices do not include transport and delivery costs, which are in any case displayed before sending the order in the shopping cart and on the payment confirmation page, as well as specified in the order confirmation email sent to the Customer. We always strive to ensure the accuracy of the information published on the website, but the breadth of the catalogue and the volume of information contained therein entail the possible risk of a technical inconvenience that mistakenly generates a sales price different from the actual one. We therefore reserve the right to cancel the order in the event of an incorrect price publication; our Customer Service will take care to notify the Customer and provide them with the correct information.

The steps for placing an order and concluding the purchase contract are clearly highlighted in the sequence of pages of the website through explanatory texts and graphics. In particular, it is advisable to view the information on withdrawal, which can be saved and printed at any time. Before sending the order, it is possible to correct any data entry errors.

The correct receipt of the order is confirmed by ORE S.r.l. through an automatically generated email response, sent to the email address provided by the Customer. This confirmation message will include the Date and Time of order execution and a 'Customer Order Number', to be used in all further communications with ORE S.r.l. The message reiterates all the data entered by the Customer, who undertakes to verify its correctness and to promptly communicate any corrections, according to the procedures described in this document.

In the event of non-acceptance of the order, ORE S.r.l. guarantees timely communication to the Customer.

PAYMENT METHODS

Credit card
The payment system currently accepts Mastercard, Visa and Maestro cards; PostePay cards are included but Visa Electron cards not enabled for online payments are excluded. In cases of purchase of goods with Credit Card payment, the transaction will be authorized at the time of the order.

8.1 In the event of order cancellation, either by the Customer or in the event of non-acceptance by ORE S.r.l., after payment has already been made, an invoice and a credit note will be issued to cancel the payment. The credit note refund will be made by bank transfer. The credit note refund will be made by reversing the credit card payment.

8.2 ORE S.r.l. reserves the right to request additional information from the Customer (e.g., landline telephone number) or to send a copy of documents proving ownership of the card used. In the absence of the requested documentation, ORE S.r.l. reserves the right not to accept the order.

8.3 At no time during the purchase procedure is ORE S.r.l. able to store information relating to the buyer's credit card, transmitted via a protected connection directly to the website of the banking institution that manages the transaction. No computer archive of ORE S.r.l. will retain such data. In no case can ORE S.r.l. therefore be held responsible for any fraudulent and improper use of credit cards by third parties, at the time of payment for purchased products.

Paypal
By choosing this option you will be redirected to the PayPal website to complete the transaction. IMPORTANT: currently, only PayPal payments from Italian paypal-verified PayPal accounts are accepted. At the time of the order, PayPal will immediately debit the amount related to the purchase made. Find out more about PayPal.

Advance Bank Transfer
In case of payment by Advance Bank Transfer, the ordered goods will only be shipped upon actual crediting of the due amount to ORE S.r.l.'s current account.
The Customer must make a bank transfer corresponding to the amount specified in the order confirmation with the following details:

DELIVERY METHODS AND COSTS

For every purchase made, O.R.E. S.r.l. - issues a payment receipt.
To request an invoice, an express request must be sent to the email address.
ATTENTION: Carefully check the data entered in the "billing address" field, it is not possible to change this data in any case once the order has entered the shipping process. The invoice will be issued to the address entered in the billing field at the time of purchase and it will not be possible to issue the invoice to a different name or address. Therefore, no changes to the invoice will be possible.

Delivery costs are borne by O.R.E. S.r.l., with the exception of a contribution of €8.90 and any additional Shipping Cost Contributions, explicitly highlighted at the time of placing the order. Payment for the goods by the Customer will be made using the method chosen at the time of the order. Nothing more is due from the Customer than the total of the order.

The availability of products for sale is limited to the availability of the products themselves and is a condition for the validity of the offers. In the event of depletion – even temporary – of stock, O.R.E. S.r.l. has the right to refuse the customer's purchase request through formal communication via email, which may also indicate any available substitute products. Unless the customer requests to purchase a product in place of the out-of-stock one, O.R.E. S.r.l. will refund any sums already paid by the Customer as soon as possible and in any case within 14 days from the date on which the order was cancelled.
If the Customer chooses the standard shipping service, the requested products will be delivered within 5/7 working days.

Unless explicitly indicated by O.R.E. S.r.l. Customer Service, delivery is understood to be at street level. Upon delivery of the goods by the courier, the Customer is required to check that the number of packages delivered corresponds to what is indicated in the accompanying invoice; that the packaging is intact, undamaged, not wet or otherwise altered, even in the sealing materials (adhesive tape or metallic strapping).

Any damage to the packaging and/or product or the mismatch in the number of packages or indications must be immediately challenged by affixing a SPECIFIC RESERVATION on the courier's proof of delivery (example: wet cardboard, etc.).

Once the courier's document has been signed, the Customer may not raise any objection regarding the external characteristics of what has been delivered.

Any problems concerning the physical integrity, correspondence or completeness of the received products must be reported within 5 days of delivery, via email to info@oreutensili.com or by filling in the Returns and Refunds form.

Storage: in case of storage due to failed delivery/collection, you will be contacted by phone to resolve the issue.

 

RIGHT OF WITHDRAWAL

Pursuant to articles 52 et seq. of Legislative Decree 206/2005, if the customer is a consumer (i.e., a natural person who purchases goods for purposes not related to their professional activity), they have the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, with the exception of product types for which this is expressly excluded (cf. art. 59 Legislative Decree 206/2005) and subject to what is indicated in subsequent point 18.

To exercise this right, the customer must send O.R.E. S.r.l. a communication to this effect, within 14 days from the date of receipt of the goods. This communication must be made by email or by filling in the Returns and Refunds form.

Once the aforementioned withdrawal communication has been received, O.R.E. S.r.l.'s Customer Service will promptly communicate to the Customer the instructions on how to return the products, which must be sent back to the following address O.R.E. S.r.l. Via Sassonia 16 - 47922 Rimini (RN) - Italy without undue delay and in any case within 14 days of authorization.

The direct costs (packaging and transport) of returning a product due to the right of withdrawal are borne by the Customer. If the product is collected by an O.R.E. S.r.l. courier, prices vary according to the weight of the items (0/10 kg €15.00; 10/25 kg €20.00; 25/50 kg €30.00). In this case, responsibility for the shipment lies with O.R.E. S.r.l.

The customer may also return the goods with a courier of their choice, but, in this case, the shipment up to the confirmed receipt at O.R.E. S.r.l.'s warehouses is under the full responsibility of the Customer.

In case of damage to the returned product during transport not carried out by O.R.E. S.r.l. couriers, O.R.E. S.r.l. will notify the customer of the incident within 5 working days of receipt of the return at its warehouses, to allow the Customer to promptly file a claim against the courier chosen by them and obtain a refund of the value of the damaged product (in this event, the product will be made available to the customer and the request for withdrawal will be simultaneously cancelled);
O.R.E. S.r.l. is in no way responsible for damage or theft/loss of goods returned with shipments managed by the customer's courier;

The right of withdrawal is in any case subject to the following conditions: the right applies to the product purchased in its entirety; it is not possible to exercise the right of withdrawal only on part of the product purchased (e.g., accessories, etc.);
The purchased goods must be intact and returned in their original packaging, complete in all their parts (including packaging and any documentation and accessory equipment: manuals, etc.); to limit damage to the original packaging, we recommend placing it in a second box; in all cases, the affixing of labels or adhesive tape directly on the original product packaging must be avoided;

O.R.E. S.r.l. will refund the Customer the entire amount already paid (net of the direct return costs referred to in the previous paragraph 18 in cases where the products are not returned directly by the Customer), within 14 days of receipt of the withdrawal communication, by Bank Transfer. It will be the Customer's responsibility to promptly provide the bank details on which to obtain the refund (IBAN code of the current account of the invoice holder).
O.R.E. S.r.l. will issue the refund after receiving the products at its warehouses.

The right of withdrawal lapses entirely, due to the lack of the essential condition of integrity of the goods (packaging and/or its content), in cases where O.R.E. S.r.l. ascertains:

the opening of the seal, which occurred after delivery, of sealed audio or video recordings or computer software;

the absence of integral elements of the product (accessories, components, manuals, ...).

In the event of forfeiture of the right of withdrawal, O.R.E. S.r.l. will provide relative communication by email; the product will remain at the Customer's disposal at O.R.E. S.r.l.'s warehouse for a period of 30 (thirty) days from the date the registered letter was sent.

After this period, the product will be disposed of without further notice.

 

WARRANTIES

All products sold by O.R.E. S.r.l. are covered by the manufacturer's conventional warranty and by a 24-month warranty for conformity defects, pursuant to articles 128 et seq. of Legislative Decree no. 206/2005. To avail of warranty assistance, the Customer must keep the invoice/virtual receipt or the DDT that they will receive via email or at their domicile simultaneously with delivery.

The manufacturer's conventional warranty is provided according to the procedures illustrated in the documentation included in the product packaging. If, following intervention by an Authorized Service Centre, the defect is not covered by the manufacturer's conventional warranty, the Customer will be charged for any verification and restoration costs requested by the Authorized Service, as well as transport costs, if incurred by O.R.E. S.r.l.

The 24-month warranty pursuant to articles 128 et seq. of Legislative Decree no. 206/2005 applies to products that present a conformity defect, provided that the product itself is used correctly, in compliance with its intended use and with what is provided in the attached technical documentation. This warranty is reserved for private Consumers (natural persons who purchase goods for purposes unrelated to their professional activity). In case of a conformity defect, O.R.E. S.r.l. will provide, without charge to the Customer, for the restoration of the product's conformity through repair/replacement or a price reduction, up to the termination of the contract. If, following intervention by an Authorized Service Centre, the defect does not prove to be a conformity defect pursuant to articles 128 et seq. of Legislative Decree no. 206/2005, the Customer will be charged for any verification and restoration costs requested by the Authorized Service, as well as transport costs if incurred by O.R.E. S.r.l.

Replacements in case of DOA (Dead On Arrival: product not working upon delivery) only occur if expressly provided by the manufacturer. The times for replacement or any repair of the product depend exclusively on the manufacturer's policies.

In the event that, for any reason, O.R.E. S.r.l. is unable to provide its customer with a product under warranty (repaired or replaced), O.R.E. S.r.l. may, at its discretion, refund the full amount paid or replace it with a product of equal or superior characteristics.

No compensation can be claimed from O.R.E. S.r.l. for any delays in repairs or replacements.

In cases where the application of warranties requires the return of the product, the goods must be returned by the Customer in their original packaging, complete in all their parts (including packaging and any documentation and accessory equipment: manuals, accessories, etc.); to limit damage to the original packaging, we recommend, when possible, to place it in a second box; in all cases, the affixing of labels or adhesive tape directly on the original product packaging must be avoided.

PRIVACY

The data controller is O.R.E. S.r.l. The Controller is autonomous and carries out the processing necessary to pursue the purposes in accordance with Legislative Decree no. 101 of 10/08/2018, which implemented EU Regulation 2016/679 (GDPR).

APPLICABLE LAW

The sales contract between the Customer and O.R.E. S.r.l. is understood to be concluded in Italy and governed by Italian Law. For the resolution of civil and criminal disputes arising from the conclusion of this distance sales contract, if the Customer is a consumer, the territorial jurisdiction is that of the court of their place of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Rimini.
