DESCRIPTION OF THE INITIATIVE AND INFORMATION FOR THE CONSUMER
The initiative is an online sale dedicated to customers of the ORESrl online shop. The offer and sale of products via the website www.oreutensili.com are governed by the following General Conditions of Sale. The General Conditions of Sale are formulated in compliance with the legislation on contracts concluded outside of commercial premises and in particular by the provisions of Legislative Decree 6 September 2005, n. 206 (Consumer Code) and subsequent amendments.

Acceptance of the general conditions of sale
By placing the order in the manner provided, the Customer declares to have read all the information provided during the purchase procedure and to fully accept the General Conditions of Sale. ORE Srl reserves the right to vary the General Conditions of Sale by giving notice on this page of the site. The applicable General Conditions of Sale are those in force at the time the order is placed. Any change will be effective after publication on the site.
The Customer, once the online purchase procedure has been completed, will print or save an electronic copy and in any case keep these general conditions of sale, in compliance with the provisions of articles 49 and following of Legislative Decree no. 206/2005 on distance selling.
PURCHASE METHODS
The Customer may purchase only the products present in the ORESrl electronic catalogue at the time of placing the order, viewable online at the address (URL) http:// www.oreutensili.com, as described in the relevant information sheets. It is understood that the image accompanying the descriptive sheet of a product may not be perfectly representative of its characteristics but may differ in colour, size, accessory products present in the figure. All information supporting the purchase is to be understood as simple generic information material, not referable to the real characteristics of a single product.
The products are offered at the price indicated on the site on the date the order is placed. Prices are inclusive of VAT which will be highlighted in detail in the invoice issued for the purchase of the product. Prices do not include transport and delivery costs, however displayed before sending the order in the shopping cart and on the payment confirmation page, as well as specified in the order receipt confirmation email sent to the Customer. We always strive to ensure the correctness of the information published on the site, but the breadth of the catalog and the amount of information contained therein entail the possible risk of a technical problem that mistakenly generates a sales price different from the actual one. We therefore reserve the right to cancel the order in the event of incorrect publication of a price, our Customer Service will take care of notifying the Customer and instructing him with the correct information.
The steps for placing an order and concluding the purchase contract are clearly highlighted in the sequence of pages on the site through explanatory texts and graphics. In particular, it is advisable to read the information on withdrawal, which can be saved and printed at any time. Before sending the order, it is possible to correct any errors in data entry.
Correct receipt of the order is confirmed by ORE Srl by means of an automatically generated email response, sent to the email address provided by the Customer. This confirmation message will report the Date and Time of execution of the order and a 'Customer Order Number', to be used in any further communication with ORE Srl. The message will reiterate all the data entered by the Customer who undertakes to verify its correctness and to promptly communicate any corrections, according to the methods described in this document.
In the event of non-acceptance of the order, ORE Srl guarantees timely communication to the Customer.
PAYMENT METHODS
Credit card
The payment system currently accepts Mastercard, Visa and Maestro cards; PostePay cards are included but Visa Electron cards are excluded and are not enabled for online payments. In the case of purchasing goods with a Credit Card payment method, the transaction will be authorized at the time of ordering.
8.1 In the event of cancellation of the order, either by the Customer or in the event of non-acceptance of the same by ORE Srl, after the payment has already been made, an invoice and a credit note will be issued as a reversal. The refund of the credit note will be made by bank transfer [The refund of the credit note will be made by reversing the credit card payment.].
8.2 ORE Srl reserves the right to request additional information from the Customer (e.g. landline telephone number) or the sending of a copy of documents proving ownership of the Card used. In the absence of the requested documentation, ORE Srl reserves the right not to accept the order.
8.3 At no time during the purchase procedure is ORE Srl able to store the information relating to the buyer's credit card, transmitted via a protected connection directly to the site of the banking institution that manages the transaction. No computer archive of ORE Srl will store such data. In no case can ORE Srl therefore be held responsible for any fraudulent or improper use of credit cards by third parties, at the time of payment for the products purchased.
Paypal
By choosing this option you will be redirected to the PayPal site to complete the transaction. IMPORTANT: currently only PayPal payments from PayPal-verified Italian PayPal accounts are accepted. Advance Bank Transfer
In case of payment by advance bank transfer, the shipment of the ordered goods will take place only upon actual crediting of the amount due to the ORE Srl account.
The Customer must make a bank transfer corresponding to the amount specified in the order confirmation with the following references:

DELIVERY METHODS AND COSTS
For each purchase made, ORESrl - issues a payment receipt
To issue an invoice, an express request must be made to the email address.
ATTENTION: Carefully check the data entered in the "billing address" field, it is not possible in any case to change this data, once the order has entered the shipping process. The invoice will be addressed to the address entered in the billing field at the time of purchase and it will not be possible to address the invoice to a different name or address. No changes to the invoice will therefore be possible.
Delivery costs are paid by ORESrl, except for a contribution of €9.90 and any additional Transport Cost Contributions, explicitly highlighted at the time of placing the order. Payment for the goods by the Customer will be made using the method chosen at the time of ordering. Nothing more is due by the Customer than the total of the order.
The availability of the products on sale is limited to the availability of the products themselves and is a condition for the validity of the offers. In the event of exhaustion - even temporary - of the stocks, ORESrl has the right to refuse the customer's purchase request by means of a formal communication via e-mail, in which any available replacement products may also be indicated. Except in the case in which the customer requests to purchase a product to replace the one that is out of stock, ORESrl will refund any sums already paid by the Customer as soon as possible and in any case no later than 14 days from the date on which the order was cancelled.
If the Customer chooses the standard shipping service, the requested products will be delivered within 5/7 working days.
Unless otherwise specified by ORESrl Customer Service, delivery is intended to be at street level. Upon delivery of the goods by the courier, the Customer is required to check:
that the number of packages delivered corresponds to that indicated on the accompanying invoice;
that the packaging is intact, not damaged, not wet or otherwise altered, including the sealing materials (adhesive tape or metal straps).
Any damage to the packaging and/or the product or the discrepancy in the number of packages or indications must be immediately contested by writing SPECIFIC RESERVATION on the courier's proof of delivery (example: wet cardboard,...)
Once the courier's document has been signed, the Customer will not be able to raise any objections regarding the external characteristics of the goods delivered.
Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 5 days of delivery, via email info@oreutensili.com or by filling out the Returns and Refunds form.
Stock: in case of stock due to failed delivery/collection, you will be contacted by telephone to resolve the problem.
RIGHT OF WITHDRAWAL
Pursuant to articles 52 et seq. of Legislative Decree 206/2005, if the customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his/her professional activity), he/she has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, with the exception of the types of products for which this is expressly excluded (see art. 59 Legislative Decree 206/2005) and without prejudice to what is indicated in the following point 18.
To exercise this right, the customer must send ORESrl a communication to this effect, within 14 days from the date of receipt of the goods. This communication must be made via email or by filling out the Returns and Refunds form.
Once the aforementioned withdrawal notice has been received, ORESrl Customer Service will promptly communicate to the Customer the instructions on how to return the products, which must be sent back to the following address ORESrl Via Sassonia 16- 47922 Rimini (RN) -Italy without undue delay and in any case within 14 days of authorization.
The direct costs (packaging and transport) of the product return for right of withdrawal are borne by the Customer. In the event that the product is collected by an ORESrl courier, the prices vary based on the weight of the items (0/10 kg euro 15.00; 10/25 kg euro 20.00; 25/50 kg euro 30.00). In this case, the responsibility for shipping is borne by ORESrl
The customer may also return the goods using a courier of his choice, but, in this case, the shipment up to the certificate of receipt in the ORESrl warehouses, is under the complete responsibility of the Customer.
In the event of damage to the returned product during transport not carried out by ORESrl couriers, ORESrl will inform the customer of the incident within 5 working days of receiving the return in its warehouses, to allow the Customer to promptly file a complaint against the courier chosen by him and obtain reimbursement for the value of the damaged product (in this eventuality, the product will be made available to the customer and at the same time the request for withdrawal will be cancelled);
ORESrl is not responsible in any way for damage or theft/loss of goods returned with shipments managed by the customer's courier;
The right of withdrawal is however subject to the following conditions: the right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the product purchased (e.g.: accessories, etc.);
The purchased item must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, etc.); to limit damage to the original packaging, we recommend placing it in a second box; in all cases, the application of labels or adhesive tape directly on the original packaging of the product must be avoided;
ORESrl will refund the customer the entire amount already paid (net of the direct return costs referred to in the previous paragraph 18 in the event that the products are not returned directly by the Customer), within 14 days of receiving the withdrawal notice, via Bank Transfer. The customer will be responsible for promptly providing the bank details on which to obtain the refund (IBAN code of the current account of the invoice holder).
ORESrl will refund after receiving the products in its warehouses.
The right of withdrawal lapses entirely, due to the lack of the essential condition of integrity of the goods (packaging and/or its contents), in cases where ORESrl ascertains:
the opening of the seal, which occurred after delivery, of sealed audio or video recordings or computer software;
the absence of integral elements of the product (accessories, components, manuals, ...).
In the event of forfeiture of the right of withdrawal, ORESrl will provide the relevant communication by email; the product will remain available to the Customer at the ORESrl warehouse for a period of 30 (thirty) days from the date of sending the registered letter.
After this period the product will be disposed of without further notice.
WARRANTIES
All products sold by ORESrl are covered by the manufacturer's conventional warranty and by the 24-month warranty for defects of conformity, pursuant to articles 128 and following of Legislative Decree no. 206/2005. To benefit from warranty assistance, the Customer must keep the virtual invoice/receipt or the DDT that he/she will receive by email or at his/her home address at the time of delivery.
The manufacturer's conventional warranty is provided according to the methods illustrated in the documentation inside the product packaging. If, following intervention by an Authorized Assistance Center, the defect is found not to be covered by the manufacturer's conventional warranty, the Customer will be charged for any costs of verification and repair requested by the Authorized Assistance, as well as transport costs, if incurred by ORESrl
The 24-month warranty pursuant to articles 128 and following of Legislative Decree no. 206/2005 applies to products that have a lack of conformity, provided that the product itself is used correctly, in compliance with its intended use and with the provisions of the attached technical documentation. This warranty is reserved for the private Consumer (a natural person who purchases the goods for purposes not related to their professional activity). In the event of a lack of conformity, ORESrl will provide, at no cost to the Customer, for the restoration of the conformity of the product through repair/replacement or a reduction in price, up to the termination of the contract. If, following intervention by an Authorized Assistance Center, the defect does not result in a lack of conformity pursuant to articles 128 and following of Legislative Decree no. 206/2005, the Customer will be charged for any costs of verification and restoration requested by the Authorized Assistance, as well as transport costs if incurred by ORESrl
Replacements in case of DOA (Dead On Arrival: product not working upon delivery) occur only if expressly provided by the manufacturer. The times of replacement or possible repair of the product depend exclusively on the policies of the manufacturer.
In the event that, for any reason, ORESrl is unable to return to its customer a product under warranty (repaired or replaced), ORESrl may proceed at its own discretion to refund the entire amount paid or to replace it with a product of equal or superior characteristics.
No damages can be requested from ORESrl for any delays in carrying out repairs or replacements.
In cases where the application of the guarantees requires the return of the product, the goods must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, accessories, etc.); to limit damage to the original packaging, we recommend, when possible, to insert it in a second box; in all cases, the affixing of labels or adhesive tape directly on the original packaging of the product must be avoided.
PRIVACY
The data controller is ORESrl. The Data Controller is independent and carries out the processing necessary to achieve the purposes in accordance with the legislative decree of 10/08/2018 n. 101 which implemented EU regulation 2016/679 (GDPR).

APPLICABLE LAW
The sales contract between the Customer and ORESrl is understood to be concluded in Italy and regulated by Italian Law. For the resolution of civil and criminal disputes arising from the conclusion of this distance selling contract, if the Customer is a consumer, the territorial jurisdiction is that of the reference court of his/her municipality of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Rimini.
